Mr. Sanyal, learned advocate for the opposite party submits before this Court that in spite of best effort, he could not serve notice upon the learned advocate for the petitioner since he has refused to accept such notice and finding no other alternative, he informed learned advocate for the petitioner with regard to the listing of this case today through Mail as well as through WhatsApp. The unreceived letter dated 27.07.2023 as written by Mr. Sanyal, learned advocate for the opposite party, the printout of the Mail dated July 28, 2023 and the printout of the WhatsApp as filed on behalf of the opposite party be taken on record. Since, none appears on behalf of the petitioner in spite of notice, the instant revisional application being CO 562 of 2015 is dismissed for default.

4. Interim order, if therebe any, stands hereby vacated.

5. Department is hereby directed to communicate this order to the learned Trial Court forthwith.

6. Parties as well as the learned Trial Court is directed to act upon the server copy of this order duly downloaded from the official website of this Court.

7. Urgent photostat certified copy of this order, if applied for be given to the parties, upon compliance of necessary formalities.

1. Learned advocate for the writ petitioner Ms. Koushikee Banerjee appears and she has submitted that she has got no instruction from her client and in support of her contention, she has handed over a photocopy of the letter dated 10.01.2023 as written by her senior, Mr. Sabyasachi Mukhopadhyay, learned advocate addressed to the petitioner of the instant case together with a photocopy of the track report.
