C.R.M. (DB) 985 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Amdanga Police Station Case No. 544 of 2021 dated 18.10.2021 under Section 302 of the Indian Penal Code.
And In Re : Palash Kahar .... Petitioner Mr. Angshuman Chakraborty Mr. S. S. Saha ... For the Petitioner.
Mr. Joydeep Biswas Mr. Shantanu Talukdar ... For the State.
The petitioner is in custody for 3 years and 7 months and prays for bail solely on the ground of his prolonged detention as well as slow pace of progress in trial.
Learned counsel for the State opposes the prayer. It appears that only 2 out of 16 witnesses have been examined so far despite direction given by this Court for expeditious disposal of the case vide order dated 2nd July, 2024 in CRM (DB) 1877 of 2024.
Considering the material on record connecting the petitioner to the alleged offence, prayer for bail is rejected at this stage.
However, learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law.
The application for bail is disposed of.
The parties are at liberty to communicate this order to the learned trial Court at the earliest.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
