Mr. S. P. Lahiri ...for the petitioner This is an application for transfer. The petitioner filed a transfer application on 7th August, 2021 which has come back to her on the ground of acute staff deficiency and also the reason was over 10 per cent of the total strength of the teachers had already been given no objection by the school. The petitioner submits that she has a child of one year of age which is to be considered by the authorities. She further submits that acute staff strength on the basis of which her application has been rejected, is not correct. She has also submitted that 10 per cent rule is also not applicable as the school is making a mistake in counting the said 10 per cent of total teachers strength.

I direct the District Inspector of Schools to call a meeting of the petitioner and the School Authority within a period of one month from the date of communication of this order to hear out the matter and if the District Inspector of Schools finds that this

is a case for forwarding the transfer application of the petitioner, he shall forward it within seven days from the date of such meeting and if he finds that it is not a case for forwarding the application of the petitioner, he will pass a reasoned order by two weeks thereafter i.e. after the meeting and will communicate the same to the petitioner. The District Inspector of Schools is also directed to take a fair decision in this regard as to the counting of the 10 per cent by the school. With this direction and observation, this writ application is disposed of.
