Singh, Mr. Dilip Kr. Ghosh ...for the State 06-05-2025 AKG Ct. 15 The petitioner seeks an electricity connection for the premises located at 18, Janak Road, Kolkata - 700 029. Pursuant to the order dated April 22, 2025, an inspection was conducted by Calcutta Electric Supply Corporation Limited (CESC). The inspection report is quoted below:

"1. During inspection, petitioner, private respondents and the police personnel of Tollygunge Police Station were present. At site we found that the petitioner is residing in a small asbestos shaded room at back side of the private respondents'

three storied building. It is technically not possible to provide separate service connection at the petitioner's occupied portion.

18, Janak Road, Kolkat700029 has an existing service connection wherein 6 live meters and 1

disconnected meter are existing. All the meters are situated in a room occupied by the private respondents.

Private respondents submitted that they have no objection, if the existing service/meters are shifted to their open Varandah. Though a new meter can be installed in favour of the petitioner at the existing meter board upon removal of disconnected meter.

Petitioner submitted the she has no problem if her meter is installed at the newly selection position upon shifting of the existing service.

We have selected a technically suitable position for shifting of the existing service/meters and installation of a new meter in favour of the petitioner.

Petitioner has to bear the cost for shifting of service and installation of a new meter in her favour. A rough sketch map is enclosed."

Learned counsel appearing for respondent nos. 5 & 6, on instructions, submits that the other inhabitants of the three-storied building are unwilling to bear the proportionate cost for shifting the existing meter board to the proposed location.

While the settled possession of the petitioner at the relevant premises is not in dispute, his tenancy under respondent nos. 5 & 6 is disputed by them.

In view of the above, I dispose of this writ petition with a direction to CESC to provide the electricity connection at the petitioner's premises by installing a loop meter at the existing meter board.

CESC shall be at liberty to remove the disconnected meter. If necessary, CESC officials may seek assistance from police personnel of the Tollygunge Police Station, at

the petitioner's cost, for the implementation of this order. It is needless to mention that the petitioner shall comply with all required formalities in this regard. Accordingly, WPA 6186 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
