He is stated to have participated in the recruitment process to the post of Constable in the RPF in the year 2002. He was not selected. His wife has been litigating before this court claiming that her husband was wrongfully treated in the process of selection. The petitioner claims to have received a letter from the Assistant Secretary to the Chairman of the Railway Board that her complaint has been forwarded to the South Eastern Railway on 31.12.2019.
The instant writ petition is filed seeking enquiry into the alleged improper practices in a recruitment process that occurred 20 years ago. The petitioner claims that she is in destitution and hardship.
This Court finds the prayers made in the writ petition utterly baseless. The petitioner has infact no cause of action against the Railways. Her husband's mental condition and her destitution cannot be attributed to the Railways. The writ petition is thoroughly misconceived and in abuse of the process of law and is hereby dismissed.
Costs are not imposed on the petitioner based on the submission made by the learned counsel for the petitioner that his client is in utter destitution.
