Versus

Susmita Ghosh Mr. Ejaz Khan Mr. Prodip Kr. De Ms. Ananya Adhikary ...for the petitioner This application under Article of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, Fast Track, 3rd Court, Howrah to dispose of an application under Section 151 of the Code of Civil Procedure filed in Matrimonial Suit No.1268 of 2023 expeditiously.

The learned advocate appearing for the petitioner submits that the petitioner herein filed an application under Section 151 of the Code of Civil Procedure for permitting the petitioner to meet with his minor daughters. He further submits that the hearing of the said application has been fixed on April 3, 2025. In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned

advocates representing the opposite parties before the learned Trial Judge.

In the light of the submissions made by the learned advocate for the petitioner CO 964 of 2025 is disposed by requesting the learned Additional District Judge, Fast Track, 3rd Court, Howrah to take up the hearing of the application under Section 151 of the Code of Civil Procedure on the next date fixed i.e., on April 3, 2025 if, the same is otherwise ready for hearing and to dispose of the same as expeditiously as possible preferably by the end of June, 2025 without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
