None appears for the petitioner. However, learned advocate for the State is present.

The writ petition was preferred being aggrieved by the inaction of the police authorities. The attention of the Court has been drawn to different documents which have been enclosed along with the writ petition. The subject-matter of the writ petition relates to land dispute and the petitioner by approaching the Executive Magistrate in M.P. Case No. 345 of 2024 was aggrieved as the police authorities did not implement the said order. Be that as it may, since the orders passed by the Executive Magistrate are for a limited period of time and are for the purposes of prevention of breach and tranquility, as such the nature of the prayers for construction of boundary wall is concerned, the same do not fall within the domain of the Executive Magistrate.

Mr. Basu, learned advocate appearing for the State opposes the contention advanced in the writ petition.

Be that as it may, the police authorities would not interfere with any property related disputes, but would obviously ensure that there is no untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations, the writ petition being WPA 6668 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
