Kausik (Allowed) CRM (M) 766 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bongaon Police Station Case No. 412 of 2025 dated 29.04.2025 under Sections 14A(B)/14C of Foreigners Act, 1946.

Learned advocate appearing for the petitioner submits that the petitioner was arrested on 29.04.2025 and is in custody for more than 11 months. Petitioner is a lady. The allegations, if proved, would result in a sentence of fixed term. Although, charge sheet has been submitted but till date witness action has not commenced.

Having regard to the same, I am of the opinion that further detention of the present petitioner is unwarranted. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Alifa Mulla shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only)

with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Bongaon.

If on bail, petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District of 24 Parganas North without the prior permission of the learned Court.

Additionally, petitioner shall furnish her address where she would be residing. The Inspector-in-Charge, Officer-inCharge of Bongaon Police Station would be at liberty to engage a police personnel who can visit and conduct a surprise check regarding the availability of the present petitioner. With the aforesaid observations CRM (M) 766 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
