The instant appeal arises out of an order of acquittal dated 31st December, 2004 passed by the learned Judicial Magistrate (1st Class), 4th Court, Alipore in Case No. C-261 of 2000. Accordingly, the instant appeal is dismissed for nonprosecution. The appellant is present in Court today. His personal appearance is noted and dispensed with.
