The grievance of the petitioner pertains to the refusal of the respondent statutory authority to provide a domestic electricity connection at the premises of the petitioner.

The respondent Distribution Company is represented and submits that the private respondents have raised an objection and that is the primary reason why the respondent statutory authorities have not been able to provide with an electricity connection. The private respondents are represented and submit that there is a pending civil suit between the private respondents and the petitioner.

I have considered the submissions of the parties. I am of the view that since the petitioner seeks an essential service, there is no question of private respondents raising any dispute in so far as the fresh electricity connection is concerned.

In view of the aforesaid, the respondent Distribution Company is directed to provide a fresh electricity connection to the premises of the petitioner in accordance with law and after the petitioner has complied with all statutory formalities. In carrying out the aforesaid exercise, the concerned police authority being the respondent no.3 are directed to give all possible assistance, if necessary.

It is needless to mention that the petitioner will bear the cost of all expenses and costs for the aforesaid electricity connection.

With the aforesaid directions, WPA 7078 of 2021 is disposed off.
