The State of West Bengal The present appeal arises out of a judgment and order dated 13.02.2015 passed by the learned Additional District and Sessions Judge, Fast Track, 1st Court, Contai, Purba Medinipur. The learned Additional District and Sessions Judge was pleased to convict the following accused persons, namely, Nakul Bera, Chandan Pramanik, Sukdev Laiya and Lakhmikanta Maity @ Laxmi Maity and was pleased to acquit accused person, namely, Bapan Pramanik. Against the said judgment and order of conviction, CRA 126 of 2015 was preferred before the High Court by accused Sukdev Laiya, Chandan Pramanik and Lakhmikanta Maitay @ Laxmi Maity and CRA 199 of 2015 by Nakul Bera. Both these appeals were disposed of by an order and judgment dated 16.08.
2019 by the Division Bench of Hon'ble Justice Joymalya Bagchi and Hon'ble Justice Manojit Mandal. The Hon'ble Division Bench dismissed the two appeals and affirmed the judgment and order of conviction of the trial Court. The present appeal being CRA 139 of 2016 has been preferred by Chandan Pramanik and Sukdeb Laiya who were the appellants in CRA 126 of 2015 which has been dismissed by the Hon'ble Division Bench.
139 of 2016 is infructuous in view of the judgment and order dated 16.08.2019 passed in CRA 126 of 2015.
Accordingly, the present appeal being CRA 139 of 2016 stands disposed of.
