The present writ application has been preferred praying for direction upon the Controlling Authority, Howrah to dispose of gratuity case no. 45 of 2022 which is pending for last three years. Learned counsel for the private respondent submits that the jurisdiction in this case will be Controlling Authority at Kolkata and not Howrah. Considering the said facts, the writ application is disposed of with the direction that the Controlling Authority, Howrah will dispose of the issue of jurisdiction on hearing the parties within 15 days from the date of this order.

In case it is held that the Controlling Authority, Howrah has the jurisdiction then the matter shall be concluded within 60 days thereafter

in accordance with law by passing a reasoned order and on hearing the parties.

It is made clear that the point of jurisdiction also shall be decided by passing a reasoned order. WPA 6181 of 2025 is accordingly disposed of.

There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
