08-04-2022 Subha Item no.28 Ct no.34
IN THE HIGH COURT AT CALCUTTA
Criminal Revisional Jurisdiction C.R.R 823 of 2018 In the matter of : Smt. Neha Chaudhary .....petitioner. In Re : An application under Section 482 read with Section 401 of the Code of Criminal Procedure.
Mr. Sabyasachi Banerjee Mr. Ravindra Tiwari ....for the petitioner.
Mr. Sudip Ghosh Mr. Bitasok Banerjee ....for the State.
The present revisional application was preferred by the petitioner who happens to be the accused by way of filing power/ vakalatnama through constituted attorney.
Petitioner's complicity in the present case is an accused. As such, I am not inclined to accept the manner in which the revisional application has been filed through the constituted power of attorney challenging the validity of the proceedings. Accordingly, the present criminal revisional application being CRR 823 of 2018 is dismissed as not pressed. Liberty is granted to the petitioner to file afresh by way of proper mode and manner. The certified copies which have been enclosed along with the revisional application be returned by the Department on the same being replaced by the Photostat copies by the
Advocate on record of the petitioner.
All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
