Lalchad @ Lalchand .......Petitioner Mr. Abhra Mukherjee Mr. Sauradeep Dutta Mr. ARpayan Mukherjee Mr. Himadree Ghosh ...for the Petitioner Though the petitioner initially sought quashing of proceedings of G.R.Case No. 1688 of 2021 pending before the learned Additional Chief Judicial Magistrate, Serampore, Hooghly, he presently prays for setting aside order dated October 10, 2023 directing issuance of warrant of arrest against him. It appears that the petitioner was granted bail by the learned Additional Chief Judicial Magistrate on October 07, 2021 with an observation that allegation under Section 307 of the Indian Penal Code was not made against him. The said allegation was only against the husband and the father in law of the victim.

The petitioner was present before the learned Magistrate all throughout. On October 10, 2023, the petitioner failed to appear before the learned Magistrate for which warrant of arrest was issued against him. The petitioner undertakes to surrender before the learned Magistrate within seven days from date. If the petitioner surrenders before the learned trial Court within seven days from date, he shall be released on bail on furnishing fresh bond of Rs.2000/- (Rupees two thousand only) with two registered sureties of like amount.

In the event the petitioner fails to surrender before the learned trial Court within the stipulated time frame, the learned trial Court shall be at liberty to take necessary steps against the petitioner in accordance with law without further reference to this Court.

The warrant of arrest issued against the petitioner vide order dated October 10, 2023 be stayed till April 03, 2025. CRR No. 1280 of 2025 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
