As none appears for the State Mr. Avirup Mondal, an empanelled lawyer of the State of West Bengal (Civil), present in Court, is appointed to represent the State in the present case. Let his appointment be regularized.

Petitioner shall serve a copy of the pleadings upon the learned counsel for the State.

The present writ application has been preferred praying for direction upon the Certificate Officer, Howrah to dispose of the certificate proceeding which was initiated in the year 2017. It appears from the materials on record that the Controlling Authority decided the gratuity case in favour of the petitioner on 25.05.2016. As the private respondent did not comply with the order the certificate was issued by the Controlling Authority to the Certificate Officer, Howrah vide a letter dated

03.03.2017. It appears that till date the proceeding has not been completed.

The said conduct of the Certificate Officer and the Administration is unfortunate. More so, as the same is the prayer for gratuity under a beneficial legislation.

In view of the said facts, the District Magistrate, Howrah, is directed to personally look into the present case and ensure that the certificate case is disposed of in accordance with law on hearing the parties by passing a reasoned order within 30 days from the date of communication of this order. WPA 6190 of 2025 is accordingly disposed of.

There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
