This application has been filed by the petitioner in Title Suit No.302 of 2012, pending before the learned Civil Judge, Junior Division, 3rd Court at Howrah, praying for expeditious disposal of the Title Suit No.302 of 2012 along with interim application for amendment.

It is urged by the learned advocate for the petitioner that the petitioner is an elderly lady and the proceeding may be directed to be heard expeditiously.

It appears from the records that on the last few occasions defendants prayed for time when the hearing of the application under Order VI, Rule 17 of the Code of Civil Procedure was fixed. Written objection has also not been filed by the defendants.

Under such circumstances, this revisional application is disposed of with a direction upon the learned court below to hear out the application under Order VI, Rule 17 of the Code of Civil Procedure within a month from the next date fixed.

The petitioner is directed to serve copies of this revisional application along with server copy of this order upon the opposite parties within a week from date. This Court has not gone into the merits of the claims and counter-claims of the parities and the learned court below will proceed independently and in accordance with law. It is also hoped that the suit shall also proceed expeditiously thereafter.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
