As it appears in the deed of partition that there is a common passage measuring around 4 ft. wide for use of all the erstwhile co-sharers, the CESC Limited shall effect connection to the respondent No.3, strictly through the common passage mentioned in the deed which the CESC also had also found during the inspection.

The entire process of installation and electrification shall be conducted in the presence of the petitioner and the respondent No.3, within a period of two months from date, subject to

compliance of other formalities by the respondent No.3. If any law and order problems crop up, the CESC shall be entitled to seek assistance from the police authorities, at the cost of the respondent No.3.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
