Mr. Bikash Shaw .......for the petitioner Mr. Abdul Hamid Mr. N. Roy ......for the State Affidavit-of-service filed be taken on record. On hearing the learned counsel for the parties it appears that the present writ application has been preferred for necessary directions upon the Certificate Officer to conclude the proceedings which was initiated in the year 2017.

It appears from the materials on record that the Controlling Authority in the present case directed payment of gratuity in favour of the petitioner on 22nd February, 2016.

As the private respondent did not comply with the said order, notice was issued to the Certificate Officer and the District Magistrate, Howrah for initiating the recovery proceedings to release the said amount of gratuity.

It appears that the said matter has not proceeded since 2018, which is unfortunate considering that the matter relates to recovery of gratuity under a beneficial legislation.

Accordingly, the District Magistrate, Howrah, is directed to personally look into the present case and ensure that the certificate case is disposed of in accordance with law on hearing the parties by passing a reasoned order within 30 days from the date of communication of this order.

WPA 6194 of 2025 is accordingly disposed of.

There will be no order as to costs.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, being given to the parties on priority basis upon compliance of all formalities.
