1. The affidavit of service filed today is taken on record.
2. The petitioner is the daughter of a former employee in the Khejuri Adarsha Vidyapith (HS), who retired in August 1990 and expired in June 2003. The erstwhile employee was a non-teaching Group-D staff and the petitioner as his legal heir and representative claims entitlement to the pensionary benefits of the erstwhile employee.
3. According to the petitioner, the other children are disentitled and she alone is entitled to the family pension as she is a widowed daughter of the erstwhile employee.
4. The petitioner was a married daughter, whose husband expired sometime in the year 2024. Thus, the petitioner as a widowed daughter became entitled to get pension being received by her father, in terms of the Memorandum No. 620-f (Pen) dated June 29, 2006.
5. The respondent no. 4 is directed to consider the question of eligibility of the petitioner to receive the family pension as well as the quantum thereof. Such decision will be taken by June 30, 2026 and will be intimated to the petitioner within a week therefrom. If found eligible, the requisite Pension Payment Order in favour of the petitioner will be issued by July 15, 2026.
6. With the afore-stated directions, the writ petition is disposed of.
7. There shall, however, be no order as to costs.
