Learned Counsel appearing for the petitioner submits that the petitioner has made a representation dated 12th November, 2020 at page 21 before the Secretary, West Bengal Board of Primary Education, Kolkata being the respondent no.4 in the instant writ petition, but the same has not been considered by the Secretary, West Bengal Board of Primary Education, Kolkata till date.

Mr. Vaisya, learned Counsel appearing for the District Primary School Council and Mr. Biswas, learned Counsel appearing for the West Bengal Board of Primary Education are present.

Heard all the parties.

As the representation dated 12th November, 2020 is still pending, I request the Secretary, West Bengal Board of Primary Education, Kolkata being the respondent no.4 to consider the representation of the petitioner dated 12th November, 2020 at page 21 of the writ petition and pass a reasoned order, as early as

possible, preferably within a period of twelve weeks from date after giving an opportunity of hearing not only to the petitioner but also to the necessary respondent authorities and to allow all the parties to produce necessary documents at the time of hearing. The Secretary, West Bengal Board of Primary Education, Kolkata is also requested to communicate such decision at an earliest.

Learned Advocate-on-record of the petitioner is also requested to serve a copy of this writ petition to the Secretary, West Bengal Board of Primary Education, Kolkata along with the order of this Court positively within 7 days from today.

The writ petition being WPA 7089 of 2021 is accordingly disposed of.

I make it clear that I have not gone into the merits of the writ petition, all the issues are left open to the Secretary, West Bengal Board of Primary Education, Kolkata to be decided by him.

There will be no order as to costs.

Since no affidavit have been invited, the allegations made in the writ petition are deemed to have been denied.

Urgent certified website copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
