This court takes assistance from the learned counsel for the applicant. Bajaj Allianz General Insurance Co. Ltd. to take the office copy of CAN application to dispose of the same.
It appears from the order dated 13th May, 2024 that this court directed the Insurance Company. Ltd. to deposit the cost as directed by the learned Tribunal and file an appropriate application for setting aside ex parte order. The Insurance Company is directed to prefer such application within 6 weeks from the date of passing of that order.
It is the contention of the learned counsel for the Insurance Company that though they have filed an application but there are some delays. The delay are unintentional and purely for official purpose. So, they sought extension of time from this court, so that, the
application filed by them before the learned Tribunal be accepted.
Having heard the learned counsel for the applicant and also considering the ground mentioned the body of application CAN 2 of 2025 it appears to me that the Insurance Company is directed to submit the cost along with the application though they have filed the same but it was filed in delay.
Considering the appropriate ground mentioned and demonstrated in the body of the application itself, the delay in filing the application and along with the cost be hereby condoned and extended for three weeks from date.
Learned Tribunal is directed to proceed with the application in accordance with law.
Insurance company is directed further to deposit the cost within three weeks from the date of passing of this order before the learned Tribunal Accordingly, the application being CAN 2 of 2025 is disposed of.
