And In Re : Bipad Naskar alias Fatik .... petitioner Mr. Shashanka Shekhar Saha ....for the petitioner Ms. Sreyashee Biswas ... for the State Mr. Dattatreya Dutta .... for the de facto complainant 1.

Learned Counsel for the petitioner submits he is in custody for more than six months. It is also submitted there is no direct evidence connecting him with the murder. He prays for bail.

Learned Counsel for the State and de facto complainant oppose the bail prayer.

We have considered the materials on record.

Petitioner is the nephew of the deceased. He assaulted the deceased with a hammer. He made extra-judicial confession to a family member. Incriminating articles i.e. weapon of offence and wearing apparels of the petitioner were seized and have been sent for forensic examination. In view of the aforesaid

materials on record and gravity of the offence, we are not inclined to grant bail to the petitioner.

4. Application for bail is, thus, rejected.
