Ms. Puspita Saha, Advocate ......for the State This criminal appeal was filed in the year 2003 against an order of acquittal dated February 27, 2002 passed by the Fifth Metropolitan Magistrate, Kolkata in Complaint Case No. 347 of 1991 (T.R. No. 139 of 1992).

In spite of administrative notice being issued repeatedly upon Mr. Saikat Mondal, learned Advocate, appointed as Amicus Curie in this case, has not turned up today also. Learned Advocate for the State is present. In view of the above and considering this is an appeal of the year 2003 against an order of acquittal, the appeal being CRA 114 of 2003 stands dismissed for default.
