Sudhanshu Mondal ... petitioner. MrTapadip Gupta Mr. Suman Bhanja ...for the petitioner Mr. Koushik Kundu Mr. Debanshu Ghorai ...for the State Report submitted by the prosecution is taken on record. This is an application under Section 483 of the BNSS, 2023, wherein the petitioner contended that he has been falsely implicated and he is in custody for about eight months and that the investigation has already been ended in charge sheet and for which his further detention may not be required and as such he may be released on bail.

Learned Counsel appearing on behalf of the State raised objection contending that 212 bottles of Phensedyl were recovered from the possession of the present petitioner. Investigation has already been culminated into a charge sheet and the charge has already been framed against the present petitioner on 18th March, 2025 and the next date is fixed for evidence on 24th April, 2025. Having considered the facts and circumstances of the case and the materials available so far in the Case Diary I find that the rigor of Section 37 of the NDPS Act attracts in the present case and as such

prayer for bail is considered and rejected.

The application, being CRM (NDPS) 347 of 2025 is disposed of. The Trial Court is directed to make every endeavour for expeditious disposal of the case, being NDPS Case No. 62 of 2024, arising out of Raninagar Police Station Case No. 456 of 2024 dated 27.07.2024 under Section 21(c) of the NDPS Act, 1985.
