C.P.A.N. 308 of 2020 in W.P.A. 21776 of 2019 Tushar Kanti Das -versus Jyotishman Chattopadhyay & Anr.

Mr. Rudranil De.

...For the Petitioner.

Mr. Gopal Ch. Das.

...For the Contemnor No. 2.

Mr. Tapan Kumar Mukherjee, Mr. Somnath Naskar.

...For the Contemnor No.1.

Learned advocate appearing for the alleged contemnors submits that an order has been passed by the Director of Local Bodies, West Bengal and the Commissioner, U.D. & M.A. Department, Government of West Bengal in compliance of the direction passed by this Court on 27th November, 2019.

The petitioner is aggrieved by the said order that has been passed.

I am afraid that the merits of the said order cannot be looked into by the Court sitting in contempt jurisdiction.

It will be open for the petitioner to challenge the reasoned order passed by the Director of Local Bodies before the appropriate forum, if so advised.

There is no requirement of proceeding with the contempt application any further.

The contempt application stands disposed of.

The reasoned order passed by the Director of Local Bodies communicated to the petitioner by communicating letter dated 13th February, 2020 be retained with the records.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
