The petitioner has come up against the alleged inaction by the WBSEDCL in giving electricity connection to the petitioner to operate his submersible pump despite the quotation amount having been deposited by the petitioner.

Learned counsel for the WBSEDCL submits that since 'Boro'

cultivation is going on in the neighbourhood where the electricity connection has been sought, both the petitioner's land and others' properties as well as 'Boro' cultivation shall be severely affected if electricity poles are installed for the purpose of giving such connection to the petitioner.

At this, learned counsel for the petitioner, on instruction, submits that the petitioner is agreeable to compensate whatever damage is caused to the

neighbours of the petitioner for installation of such poles.

In view of such stand of the petitioner, there cannot be any further impediment in giving the electricity connection immediately to the petitioner.

Accordingly, WPA 6718 of 2024 is disposed of by directing the WBSEDCL to give electricity connection to the petitioner by installing the necessary electricity poles at the earliest, preferably within one month from date.

In the event any objection is raised by any of the neighbouring land owners, the WBSEDCL shall approach the concerned District Magistrate under Rule 3 of the Works of Licensees Rules, 2006 for getting permission to make such installations. 7.

It is expected that if such approach is made, the District Magistrate shall resolve the issue within three weeks of such approach.

The compensation, if any, awarded to the persons whose lands/crops are damaged due to the work done for giving electricity connection to the petitioner shall be quantified and intimated by the WBSEDCL to the petitioner.

Upon such intimation, the petitioner shall ensure that such compensation is duly paid to the persons who are entitled to the same through the

WBSEDCL, positively within one month of such intimation by the WBSEDCL.

10. There will be no order as to costs.

11. Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
