Apprehending arrest in connection with Salboni Police State Case No.261 of 2019 dated 23.12.2019 under Sections 498A/406/376/307/34 of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act and Section 8 of the Protection of Children from Sexual Offences Act, 2012, the petitioner has filed the present application. The learned advocate for the petitioner submits that the petitioner is the son of the brother-in-law of the de facto / complainant and he has been falsely implicated in the case along with other relations. Additionally, the learned advocate submits that the petitioner would abide by each and every condition which could be imposed by this Court in case his prayer is allowed.

Mr. Datta, learned advocate appearing for the State opposes the prayer for anticipatory bail and submits that name of the petitioner is appearing in the statement of the witnesses.

We have perused the materials in the case diary. On appreciation of the same, we are of the opinion that custodial detention of the petitioner is not warranted in the facts and circumstances of the case. As such, the prayer for anticipatory bail of the petitioner is allowed.

Accordingly, in the event of arrest the petitioner, viz. Soumyadeep Sau @ Soumyadeep Show @ Soumyadeep Shaw, shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 The application for anticipatory bail, being CRM 2762 of 2020, is, thus, disposed of.
