22.12.2022 Court No.35 Item No. 17 D.Hira CRR 544 of 2015 Ranjit Mondal & Ors.

Vs.

The State of West Bengal None appears on behalf of either of the parties. This matter is pending in the list since 21.11.2022 and has been called on each day of working of this Court since that date. In spite of that no one is appearing. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit. This revision is to assail the order dated 11th February, 2015 passed by the Additional District judge of Amta, Howrah in connection with Amta Police Station Case No.46 of 2014 dated 5th February, 2014 under Sections 448/427/323/325/379/342/506/376D/120B of the Indian Penal Code.

In the said order assailed in this revision the Trial Court has refused petitioners' prayer to stay the proceedings till receipt by him of the D.N.A. test report or bite marks report from CFSA. That to the same has been made on the count that the petitioner shall suffer immense prejudice in trial without perusal of the said reports. On perusal of the entire materials available on record and the grounds made up by the petitioners I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this Court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 544 of 2015 is dismissed. Certified website copies of this order, if applied for, be supplied to

the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
