S. Case No. 569 of 2020 dated 25.7.2020 under Sections 147/148/149/188/186/325/326/307/332/33/353/427 of the Indian Penal Code read with Section 3 of the PDPP Act, read with Section 9 of MPO Act read with Section 55(b) of Disaster Management Act.

CRM 2547 of 2021 is dismissed as not pressed on the prayer of the petitioner no.1, namely, Salekh Khan @ Md. Salek as he was taken into custody during the pendency of the present petition. Learned advocate for the petitioner nos.2 and 3 submits that they were falsely implicated.

Learned advocate for the State submits that the petitioner nos.2 and 3 were involved in the act of assaulting police personnel amongst other.

Considering the gravity of the offence and the involvement of the petitioner nos.2 and 3 therein, we are unable to grant anticipatory bail to the petitioner nos.2 and 3, namely, Rabi Sekh @ Rabbi Sk. and Jiaul Khan @ Jiyaul Khan. Accordingly, prayer for anticipatory bail of petitioner nos.2 and 3 is rejected.

CRM 2547 of 2021 is dismissed.
