And In Re : Pintu @ Pintu Ali ..... petitioner Ms. Minoti Gomes ... for the petitioner Mr. T. D. Nandy Mr. A. Basu ... for the State Petitioner seeks anticipatory bail.

Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. There was a property dispute between the family members. The de-facto complainant was set up by her husband to lodge the false complaint. Learned advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure (Cr.P.C.). In her 164 Cr.P.C. statement, the victim claims that the petitioner attempted to ravish her. She also proceeded to state that the room belonging to her was set on fire. The incident of fire is corroborated by the materials available in the case diary. Considering the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1574 of 2022 is dismissed.
