C.R.M. 2774 of 2020 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 13.03.2020 in connection with Uluberia P. S. Case No.232 of 2015 dated 30.03.2015 under Sections 495/304/34 of the IPC.

Co-accuseds have been granted anticipatory bail. Learned lawyer for the State produces the Case diary. In view of the extent of complicity of the petitioner in light of the aforesaid submission and that co-accuseds similarly circumstanced with the petitioner have been granted pre-arrest bail, we are inclined to extend the same privilege to the petitioner also.

Accordingly, we direct that in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
