C.R.R. No.810 of 2012 D/L.32 July 14, Bpg.

In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973;

In the matter of : Amjad Khan @ Raja. ...petitioner. The present revisional application has been preferred against the judgment and order dated January 16, 2012 passed by the learned Judicial Magistrate, Second Court, Paschim Medinipore in M.R. Case No.151 of 2009 (T.R No.221 of 2009). Record reflects that the learned Magistrate by the order dated January 16, 2012 was pleased to award maintenance of Rs.1,000/- per month to the wife and Rs.1,000/- per month to the minor daughter aggregating of Rs.2,000/- per month. The record of the revisional application reflects that none appeared on behalf of the petitioner on 16.05.2012. Today also when the matter is called on, none appears on behalf of the petitioner.

Taking into account the quantum involved in the award of maintenance, I am of the view that the same is a meagre amount for an individual to survive, having regard to the present cost of living. As such, this Court do not find any reason to interfere with the impugned proceedings.

Thus, CRR 810 of 2012 is dismissed.

Pending applications, if any, are hereby disposed of. Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
