1. This revisional application seeks expeditious disposal of two interlocutory applications, one under Order 39 Rule 1 and 2 read with Section 151 of the Code of Civil Procedure, 1908 and the other under Order 39 Rule 4 of the Code filed in Title Suit No.1646 of 2025 before the learned Civil Judge (Junior Division), 3rd Additional Court, Alipore, South 24-Parganas.

2. It is submitted by the learned advocate appearing for the petitioner that the petitioner has been suffering an order of injunction and that, an application seeking vacation thereof filed by the petitioner has been pending since long.

3. In view of the nature of the order proposed to be passed, prior service of notice of the revisional application along with a notice is not being directed, however, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite party within a week from date.

4. Having heard the learned advocate appearing for

the petitioner and having considered the material on record, this revisional application is disposed of by requesting the learned Civil Judge (Junior Division), 3rd Additional Court, Alipore, South 24Parganas to dispose of the application for injunction under Order 39 Rule 1 and 2 of the Code as well as the application for vacating the interim order under Order 39 Rule 4 of the Code as expeditiously as possible preferably within a period of three months from the next date fixed.

5. The petitioner shall be at liberty to file an application for putting up of the records and seeking disposal of the aforesaid applications before the learned Judge-in-charge, in case, the Court of the learned Civil Judge (Junior Division), 3rd Additional Court, Alipore, South 24-Parganas is vacant.

6. With the aforesaid observations, CO 956 of 2026 stands disposed of. No costs.

7. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.)
