Mr. Dipendra Narayan Roy, the Chairman, Tamralipta Municipality, has appeared before the Court to answer the Rule. His unqualified apology is accepted. Personal appearance of the alleged contemnor is dispensed with.

Contempt proceeding is dropped in view of the fact that the Chairman, Tamralipta Municipality has already passed an order which has since been communicated to the petitioner. The merit of the order has not been gone into. The petitioner is always at liberty to challenge the same, in accordance with law.

The points which have been urged by learned Advocate for the applicant with regard to non-

consideration of his client's contentions by the municipality, shall be decided by the appropriate forum. The contempt rule is discharged. Contempt application is disposed of.

All parties are to act on the basis of the server copy of this order.
