Petitioner is aggrieved by the progress of Misc. Case No. 110 of 2019 under Section 12 of the Protection of Women from Domestic Violence Act pending before learned Judicial Magistrate, 1st Court, Kalna.

The learned trial court is directed to take into account that almost more than four years have passed since the initiation of the case. If an application relating to Section 23 of the Protection of Women from Domestic Violence Act is pending, learned Magistrate would dispose of the same and thereafter proceed with the case for evidence fixing one date in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties.

With the aforesaid observations, the revisional application being CRR 1007 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
