The petitioner complains that the private respondent brother, with whom their father's property has been mutually partitioned, is disturbing possession and the son has assaulted him. The Palashipara P.S. has received a complaint and has caused enquiry. The dispute between the petitioner and private respondent is purely civil in nature. Appropriate civil remedies may sought for in this regard.

The Palashipara P.S. is however ensure that there is no breach of peace of this area.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.
