... for the State This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 306, 506 read with Section 34 of the Indian Penal Code .
Let a copy of this application be served upon Mr. Imran Ali, learned counsel, who is present in court today and who ordinarily appear on behalf of the State. His engagement may be regularized in due course by the competent authority of the State.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. The FIR was lodged in 2013 and the charge-sheet was submitted in February, 2014. The prosecution intends to examine seven witnesses in this case. On 09.03.2015 charges were framed. Yet, since 2017, the trial is held up for the examination of the investigating officer of the case. The proceeding has remained pending for no fault of the present petitioner.
Learned counsel for the State submits that the State would not come in the way if a direction is passed to expedite the trial.
I have heard the submissions of the learned counsel appearing for the petitioner and the State and have perused the revision petition.
A proceeding that was started in 2013 has not been concluded yet. It is very strange that most of the witnesses mentioned in the charge-sheet were examined by 2017 and yet, till date the trial could not be concluded.
In view of the above and in the interest of justice, I request the learned trial court to dispose of the matter as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of six months from next date of hearing.
With these observations, the revisional application is disposed of.
