The grievance of the petitioners is for removal of unauthorised pucca structure over the government land.

It is submitted on behalf of the petitioners that there is illegal and unauthorised construction which is taken place and the same be removed.

The State is represented and submits that an appropriate proceeding has already been initiated under Section 10 of the West Bengal Highways Act, 1964.

In view of the fact that a proceeding has been initiated under the aforesaid provisions of law, there is no scope of passing any order in favour of the petitioners.

The State respondents are directed to take the proceedings to the logical conclusion after giving a right to all the affected parties in accordance with law. With the aforesaid directions, WPA 7143 of 2021 is disposed off.
