The petitioner submits that the petitioner's application under Section 14 of the SARFAESI Act, 2002 has been kept pending inordinately.

There was a previous round of litigation when the coordinate Bench directed that the matter shall be disposed of.

Subsequently the matter was heard by the Magistrate during the pre-COVID period but it was kept indefinitely pending without passing any order despite repeated requests by the petitioner.

The petitioner seeks a disposal of the application. 5.

Affidavit-of-service filed in court today be kept on record.

None appears for the respondents despite service. 7.

WPA 5982 of 2022 is disposed of by directing respondent no.2, the District Magistrate, Hooghly to dispose of the petitioner's pending application under

Section 14 of the SARFAESI Act at the earliest, positively within three weeks from the date of communication of this order to the said respondent by acting on a server copy of this order without insisting upon prior production of a certified copy.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
