1. By filing this writ petition the petitioner alleges that allocation of right to operate ferry service in nearby ferry ghats is crystallized and it is being handed over to chosen persons. In the writ petition the petitioner has referred to another writ petition filed before this Court, being WPA 4558 of 2025 by one Ajharuddin Gazi. In paragraph 4 of the writ petition various details concerning the said Ajharuddin Gazi have been mentioned.

2. Learned advocate appearing for the State has rightly pointed out that this public interest litigation may be at the behest of the said Ajharuddin Gazi. However, the said writ petition pertains to previous notification and not the current auction notification.

3. Since notification has already been issued and this is a case in the nature of public interest litigation,

setting aside of the notification does not arise. Furthermore, we note that the petitioner has not submitted any representation to the authorities before filing this writ petition seeking issuance of writ of mandamus. Accordingly, this writ petition stands disposed of giving liberty to the petitioner to submit his representation to the Sub-Divisional Officer, Basirhat Sub-Division, who shall consider the representation in accordance with law within a period of twelve weeks from the date on which the writ petitions is submitted.
