For the respondent No. 8 Ms. Sipra Majumder, Ms. Prativa Ghatak ... for the State Petitioners submit that the Panchayet has illegally sanctioned the plan in favour of the private respondent for making construction over a common passage.

The aforesaid allegation of the petitioners is denied by the private respondents.

It is not open for the Writ Court or for the Prodhan to enter into the private dispute in between the parties as to whether the passage in question is common or not. The petitioners are accordingly relegated to the appropriate forum, to take necessary steps, in accordance with law, for redressal of their grievances, if so advised. WPA 7154 of 2021 stands dismissed.
