1. Affidavit of service filed on behalf of the petitioner is taken on record.
2. Learned advocate representing the petitioner submits that after the incident of altercation between the petitioner and Chiranjit Dutta on 30th January, 2026 a complaint was lodged on 20th February, 2026 before the concerned police authority but appropriate steps were not taken based on such complaint which prompted the petitioner to approach this Court seeking necessary direction upon the police authority to take steps.
3. Mr.
Ansar Mondal, learned Additional Government Pleader appears on behalf of State respondents and has filed a communication
dated 25th March, 2026 of Inspector of Police, Nabadwip P.S. Nadia and same is taken on record.
4. It is disclosed in the communication dated 25th March, 2026 that on receipt of complaint from the petitioner on 20th February, 2026 it was enquired into.
Enquiry officer met the petitioner as well as one Chiranjit Dutta and demanded documents in support of the statements made in the complaint but same was not produced. Chiranjit Dutta, also was not able to produce supporting documents. As Chiranjit Dutta threatened the petitioner criminal prosecution was initiated under Section 126 of BNSS being Nabadwip P.S. NCR No. 108/2026 dated 4th March, 2026 in order to prevent untoward incident.

In connection with the same incident of altercation between the petitioner and Chiranjit Dutta on 30th January, 2026 on finding sufficient ground petitioner was arrested under Section 34(V)/61 of the Police Act. However, subsequently petitioner was released on personal bond. One Nabadwip P.S. GDE No.
1702 dated 30th January, 2026 was recorded.
6. In view of the facts disclosed in the communication dated 25th March, 2026 it
appears that concerned police authorities have taken steps. Therefore, at this stage, Court is not inclined to issue further direction upon the police authorities save and except directing the concerned police authorities to take further steps in accordance with law, if so required. Petitioner shall also be at leave to approach jurisdictional Magistrate in case it is found necessary.
7. Writ petition stands disposed of.
8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
