It appears from the instruction given by the District Inspector of Schools (P.E.), Howrah to the learned advocate representing the State respondents that the petitioner prayed for appointment in the died-inharness category and the prayer of the petitioner was forwarded by the Chairman, District Primary School Council, Howrah to the District Inspector of Schools (P.E.) vide memo No. 249 dated 21st March, 2016. The documents of the petitioner were thereafter forwarded by the District Inspector of Schools (P.E.), Howrah to the District Inspector of Schools (S.E.), Howrah for taking further action as per Rule vide Memo No. 126 SE dated 1st April, 2016.

The District Inspector of Schools (P.E.), Howrah is not aware as to whether further steps were taken in the

matter by the District Inspector of Schools (S.E.), Howrah.

As it appears that the prayer of the petitioner for granting compassionate appointment was forwarded by the Council to the District Inspector of Schools (P.E.), and thereafter to the District Inspector of Schools (S.E.), accordingly, the District Inspector of Schools (S.E.), Howrah shall take necessary consequential steps in the matter to consider the prayer of the petitioner for grant of appointment on compassionate ground strictly in accordance with law, at the earliest but positively within a period of eight weeks from the date of communication of a copy of this order.

The District Inspector of Schools (S.E.) shall intimate the petitioner the fate of her application immediately thereafter.

Learned advocate-on-record for the petitioner is granted leave to implead the District Inspector of Schools (P.E.), Howrah and the District Inspector of Schools (S.E.), Howrah as party respondent in the present writ petition. The requirement of serving of a copy of the writ petition upon the added respondents stands dispensed with as learned advocate has already entered appearance on behalf of the State respondents and instructions have also been forwarded by the District Inspector of Schools (P.E.), Howrah to the learned advocate.

The instruction given by the District Inspector of Schools (P.E.), Howrah dated 6th May, 2022 be retained with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
