The petitioner alleges that an area over and above the acquired area is in possession of Teesta Barrage. The learned advocate appearing for the petitioner draws the attention of the Court to a memo dated 18th February, 2019 in support of his contention that land measuring about 0.22 acres in excess of the acquired land is found to be in possession of the Teesta Barrage. The petitioner submitted a representation before the Special Land Acquisition Officer, Raiganj, Uttar Dinajpur dated 14th January, 2026 requesting the said respondent authority to pay compensation to the petitioner in respect of the excess land possessed by the Teesta Barrage. The learned advocate appearing for the State submits that the decision on such representation shall be

communicated to the petitioner within the time limit as may be fixed by this Court.

It appears from the memo dated 18th February, 2019 that land measuring about 0.72 acres was acquired vide L.A. Case No. 5/79-80 and land measuring about 2.04 acres was acquired in L.A. Case No. 101/77-78 and the same was handed over to the Teesta Barrage. It further appears from the materials disclosed in the writ petition that a joint enquiry was held in order to find out the utilization pattern of Plot No. 940 within Mouza Gaisal, J.L. No. 74 under Police Station Islampur in the District of Uttar Dinajpur and as per the joint enquiry report dated 29th December, 2017 it was found that Teesta Barrage has excess land possession of about 0.22 acres.

The petitioner has submitted a representation before the Special Land Acquisition Officer, Raiganj, Uttar Dinajpur dated 14th January, 2026.

This Court, therefore, feels that interest of justice would be sub-served if the Special Land Acquisition Officer, Raiganj, Uttar Dinajpur is directed to communicate its decision on the said representation to the petitioner within a specified time frame. Accordingly, WPA 6613 of 2026 stands disposed of by directing the Special Land Acquisition Officer, Raiganj, Uttar Dinajpur being the 5th respondent to consider the representation of the petitioner dated 14th January, 2026

and dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or any other person who may be affected by such decision or their authorized representative and communicate the decision to the petitioner and others as expeditiously as possible but positively within a period of ten weeks from the receipt of a server copy of this order along with a copy of the representation dated 14th January, 2026. There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
