The petitioner is absent on the fourth day. On three earlier dates the matter was adjourned at the instance of the petitioner. This Court is therefore of the view that the petitioner is not interested in pursuing the matter. This court has also considered the allegation made against the petitioner and the case records and even otherwise does not find any reason to interfere with the application under Section 438 CrPC and stands dismissed.
