Report filed by the State is also taken on record. By the present writ petition, the petitioner seeks direction upon the respondent authorities for disbursement of the outstanding amount in respect of the work executed in connection with common quotation no.259/SAL/MGNREGS/2020-21 dated 7th October, 2020.

The petitioner contends that he has completed the work allocated to him under the aforesaid common quotation.

There is an outstanding amount of Rs.33,00,000/-.

The petitioner has made representation before the respondent authorities including the District Magistrate, Bankura on 13th October, 2023. However, till date no step has been

taken for disbursement of the said amount. Hence, this writ petition.

Mani Sankar Chattopadhyay, learned Advocate for the petitioner seeks direction upon the respondent authorities for disbursement of the outstanding amount in favour of the petitioner. Ms. Kakali Samajpaty, learned Advocate for the State-respondents submits that no tender process was executed at that point of time. However, she concedes that the petitioner has completed the work as allocated to him.

It is not in dispute that the petitioner completed the work allocated to him under common quotation. Accordingly, the writ petition being WPA 6759 of 2024 is disposed of directing the District Magistrate, Bankura, respondent no.2, to take steps for disbursement of the outstanding amount in respect of the work executed by the petitioner against the common quotation within a period of six weeks from the date of communication of this order.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

Learned advocate for the petitioner is directed to communicate this order to respondent no.2, District Magistrate, Bankura, for necessary compliance. Interim order, if any, stands vacated.

All connected applications, if any, stand disposed of.

There shall be no order as to costs.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
