Petitioners have challenged the continuance of Andal P. S. Case No. 4 of 2021 dated 04.01.2021 wherein the Investigating Agency on conclusion of investigation has submitted the chargesheet under Sections 498A/406/506/34 of the Indian Penal Code.

Petitioners are directed to serve a copy of the revisional application upon Mr. Manoranjan Mahata, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course.

I have perused the enclosures in the revisional application and I find that the copies and documents under Section 207 of the Code of Criminal Procedure are yet to be supplied to the petitioners.

Petitioners would be at liberty to canvass the points advanced in the present revisional application at the stage of Section 239 of the Code of Criminal Procedure if so advised. If an application under Section 239 of the Code of Criminal Procedure is filed, the learned Magistrate would dispose of the same at the earliest preferably within a month from the date of the filing of the said application.

With the aforesaid observations, the present revisional application being CRR 1097 of 2022 is disposed of.
