The petitioner alleges that the payment which was supposed to be made in terms of the work order issued to him has not been cleared by the Gram Panchayet. It has been submitted that though part payment has been made, the final payment is due.

The petitioner claims to have made representation before the Prodhan of the Gram Panchayet by letter dated 1st May, 2020 followed by reminder dated 23rd November, 2020 and complains that the same has not been considered by the respondent authority till date.

The learned advocate representing the Prodhan of the Gram Panchayet submits, upon instruction, that the petitioner is not entitled to the payment as claimed. Be that as it may, as it appears that the representation of the petitioner demanding the payment is pending consideration at the end of the respondent the instant writ

petition is disposed of by directing the respondent No. 2, the Prodhan of Dogachhia Gram Panchayet to consider the representation of the petitioner, strictly in accordance with the relevant rules/guidelines /circulars at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order. The aforesaid respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter. It is needless to mention that the petitioner shall be afforded an opportunity of hearing to place relevant documents in his support prior to passing a reasoned order. WPA 7167 of 2021 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
