The petitioner says that he is in custody for about six months. He has been falsely implicated. The actual person who hired the sharp shooter and got the victim murdered is one Parag who has been enlarged on bail by the learned Trial Court. The petitioner prays for bail.

Learned State Advocate has shown us the statement of two eye witnesses to the alleged incident recorded under Section 164 of the Criminal Procedure Code. Both of them say that they saw three persons running away from the place of occurrence and the victim lying on the floor after being shot at. Subsequently in test identification parade, the two eye-witnesses identified all three persons including the present petitioner.

We, therefore, see that there is prima facie sufficient incriminating material against this petitioner. The charge is of
murder. Hence, we are not inclined to enlarge the petitioner on bail, at this stage.

CRM (DB) 1009 of 2025 is, thus, dismissed.
