The petitioner is an Assistant Teacher of the subject Bio- Science at Sagarpara Balika Vidyalaya (High School), District: Murshidabad, she is praying general transfer to any school nearer to her residence at Habra, District: North 24-Parganas on the grounds that the distance between her residence and the school is more than 220 kilometres and she is suffering from serious type of gynecological disorders.

It appears from the report filed by the District Inspector of Schools (SE), Murshidabad, the respondent no. 5 herein, that the school has more than 2000 students and has 37 sanctioned posts of Assistant Teachers, out of which 7 teachers have already taken general transfer. The school at present, is in shortfall of 15 teachers.

There are 4 sanctioned posts of Assistant teachers of the subject Bio-Science in the school, the

petitioner is one of such teachers. Though there is no vacancy in the said 4 posts but considering the Pupil-Teacher Ratio of the school which is 98:1, this Court is not inclined to entertain the prayer of the petitioner for general transfer.

WPA 6418 of 2023 is dismissed without any order as to costs.
